Powellslaw successfully represented a mortgage lender in the Court of Appeal when the Court decided that it was an abuse of process for the borrowers to seek to pursue a claim against the lender on the basis that the borrowers alleged that the mortgage was unenforceable under section 26 of the Financial Services and Markets Act 2000, when  the lender had been granted a possession order by the court some two years earlier.
